Terms and Conditions
These Terms & Conditions (“T&Cs”) set out the agreement between you (“the Client”) and Megan Nancy (“the Creator”). By booking any service, you agree to the following:
1. Booking & Payments
A non-refundable booking fee is required to secure your date.
50% of the total package price
Bookings are not confirmed until payment has been received.
The remaining balance is due no later than 14 days prior to the session or wedding, unless otherwise agreed in writing.
All payments made are non-refundable under any circumstances, including cancellation by the Client.
2. Cancellation & Rescheduling
In the event of cancellation by the Client, all payments made are non-refundable.
Rescheduling may be offered at the Creator’s discretion and is subject to availability.
For weddings cancelled within 90 days of the event, the full balance remains payable.
If the Creator is unable to attend due to unforeseen circumstances (such as illness or emergency), all monies paid will be refunded, or a suitable replacement photographer/videographer will be arranged with the Client’s approval.
3. Client Responsibility & Consent (Weddings & Events)
The Client is responsible for ensuring that all individuals attending the event are aware that photography and/or videography will be taking place.
By booking, the Client confirms that they have obtained the necessary consent from guests to be photographed and/or filmed.
The Creator will not be held liable for any disputes relating to consent from individuals present at the event.
4. Image & Film Delivery
6 - 10 weeks, often sooner!
During busy periods, turnaround times may be extended. The Client will be notified where applicable.
Galleries remain active for 3 months. After this time, reactivation may incur a fee.
Clients are responsible for downloading and safely storing their images. The Creator is not liable for loss after gallery expiry.
5. Copyright & Usage
All images and video content remain the intellectual property of the Creator.
The Client is granted a personal use licence, allowing:
Printing
Sharing with family and friends
Use on personal social media
Images and video content must not be altered, edited, sold, or used for commercial purposes without prior written consent.
6. Marketing & Promotional Use
The Creator reserves the right to use any images and video content for:
Portfolio
Website
Social media
Marketing and promotional materials
By booking, the Client grants full permission for such use unless otherwise agreed in writing prior to the session or event.
7. Creative License
The Creator retains full creative control over:
Style of shooting
Editing and colour grading
Image and video selection
Not all content captured will be delivered. Only work that meets professional and artistic standards will be included.
8. Liability
The Creator is not liable for circumstances beyond their control, including but not limited to:
Weather conditions
Venue restrictions
Delays or lateness
Interference from guests
In the unlikely event of total photographic or videographic failure, liability is limited to a refund of monies paid.
The Creator holds appropriate public liability and professional indemnity insurance.
9. Data Protection & Privacy
Client information is stored securely and used solely for the purpose of delivering services.
Information will not be shared with third parties except where necessary (e.g. print labs, gallery providers).
10. Agreement
By booking with Megan Nancy, you confirm that you have read, understood, and agree to these Terms & Conditions.
